New York Private Detective Tips on Process Servers Service


New York Private Detective while delivering legal documents, a summons and a complaint to a defendant could face difficulties when they cannot be reached or available.  In most cases some individuals ignore the service of process or avoid the service and then deny that they were not provided service properly.

Courts do not accept claims that the defendant was not served properly. NYC Private Investigators will make several attempts cooperatively before dropping off the legal documents in an unfavorable way for example dropping it off outside a door. 
Here are some cases of process server’s service.
  •  A process server made many attempts at the defendant’s door and knew the woman was home but would not answer her door. He saw the woman sitting next to an open, first-floor window shredding lettuce and washing it in a colander. The process server was frustrated and tossed the summons in the colander. 
The court believed this method of service was creative and considers the process server’s toss as effective service. 
  •  The process server attempted to serve the defendant four times at his residence leaving notes and asking the defendant to contact the process server.  The fifth attempt the defendant hid in the house and refused to answer the door but responded to the intercom and was observed looking out a window.  Disturbed, the process server visually showed the summons and complaint and stated “You are served”, dropping the summons and complaint at the front doorstep of his residence.  The server completed a proof of service and filed it with the court.  According to the defendant he filed jurisdiction on lack of service.  
The court rejected the claim because the defendant failed to fight against the summons and complaint.

 In summary, courts do not accept claims that the defendant was not served properly.  If  NYC Private Investigators Process Server comes to the defendant’s front door, they should answer it and take documents.
